Poke Digital provides website design, UI/UX design, and related digital product services. Specific project scope, deliverables, timelines, and pricing are agreed separately with each client in a written proposal, quote, or agreement, which takes precedence over these general Terms for that engagement.

3. Intellectual property

Unless otherwise agreed in writing, Poke Digital retains ownership of design concepts, drafts, and working files until a project is paid for in full. Upon full payment, ownership of final agreed deliverables transfers to the client, excluding any third-party assets, tools, licences, or Poke Digital's proprietary frameworks and code libraries, which remain licensed for the client's use as applicable.

4. Payment

Payment terms are set out in individual project agreements or invoices. Late payments may incur additional charges or result in a pause of ongoing work, as specified in the relevant agreement.

5. Client responsibilities

Clients are responsible for providing timely feedback, content, and access needed to complete a project, and for ensuring any content or materials supplied to us do not infringe on third-party rights.

6. Limitation of liability

To the extent permitted by law, Poke Digital is not liable for any indirect, incidental, or consequential damages arising from the use of our website or services. Our total liability for any claim relating to a project is limited to the fees paid for that project.

7. Third-party links and tools

Our website may reference or link to third-party tools and services. We are not responsible for the content, availability, or practices of third-party sites.

8. Governing law

These Terms are governed by the laws of the Republic of South Africa. Any disputes will be subject to the jurisdiction of the South African courts.
